LEGAL AND ETHICAL ASPECTS CONCERNING THE DISPLAY OF HUMAN REMAINS IN ANATOMIC MUSEUMS

Death shows that there is a limit to everything concerning our life in this world. In former times only a few well preserved parts of the body or, in exceptional cases, whole bodies were displayed in anatomic museums. However, the public gradually found itself faced with the issue of increasing interest regarding dead bodies and their anatomy. Consequently, it is hardly surprising to see a wide circle of unresolved questions arising. The most important of these is to whether and to what extent anatomical specimens of human origin should be accessible to public view, not only to doctors and to medical students but also to lay persons.

If we look to the law for security or clarity on this issue, then it becomes evident that what exists is a loose web of norms that are by no means either definite or definitive. Only few anatomical acts exist, and they themselves address very few questions regarding the treatment of bodies. Moreover, rules about the treatment of bodies have to be derived from fundamental general principles. The statement describes some of these ethical and legal rules. Due to this, fundamental questions concerning corpses must be explored. They are as follows: What obligations are there and to whom do they apply? What shall we do with human remains without any donation? Are we obliged to remove them from display and to bury them as regulated by their native conventions and customs? Or is it permissible to further keep these specimens without restrictions in museum?

At first, we have to clarify the status of the dead body. In Germany and in Switzerland, we are of the opinion that everyone is allowed to donate his or her dead body to the anatomy. In principle, the law accepts the appropriation of corpses or parts of them. The existence of anatomical bodies shows us a legal fact. The long time practice of body-donation to anatomy has progressed to such a point, that it is barely questioned in society as a whole. This is reflected in the ever-growing spectrum of the commercial and non-commercial use of body%u2019s and/ or parts of them.

Long before the ethical discussion concerning the display of human remains started, museums dedicated to pathology and anatomy, set for themselves the goal of generating public discourse on healthy and pathological functions of the human body. In fact, the right to donate one%u2019s body is part of the tradition of donating bodies to anatomical institutions. For this reason, human remains can arguably be categorised as having certain characteristics of property or possession. This provisional result seems to be consistent with the European Convention on Human Rights and Biomedicine and the additional protocol on Transplantation of Organs and Tissues of Human Origin. Both legal norms prohibit the commercial use of human remains. But they do not outlaw the right of ownership concerning the body.

Defining the status of corpse purely in terms of property laws, however, is not convincing when addressing the issue of ownership of a human corpse. For example, property ownership carries with it the right of owners to do with their property as they see fit. The following is therefore clear: Although the deceased is no longer considered a person in his or her own right, some legal right to which they were entitled during their lifetime remain for a defined period of time %u2013 depending on their circumstances of death. The continuity of human dignity beyond the death means while corpses and human remains are objects, they are not generally considered property.

In light of this, decisions made by the deceased regarding the type and location of his or her funeral become important and the European convention of bioethics makes organ donation depended primarily upon the consent of the deceased. If no consent %u2013 written or otherwise %u2013 has been expressed, the consent of the next of kin or those persons whom the deceased has authorized is required. The presumed will of the deceased, however, must be taken into consideration %u2013 insofar as it is known. In any case, the discussion doesn%u2019t end at this point %u2013 most especially because law allows for something equating to an ethical minimum. Ethics, as the general conviction of the right, the true and the socially acceptable out way (or takes precedents over) written and unwritten rules. Law and ethics complement one another and need each other. Nevertheless, there are wide ranges of varying opinions on how anatomic specimens should be treated. What we have to recognize is, that all legal decisions define the so-called ethics minimum. Real ethics goes beyond these limits.

Ölüm, bu dünyadaki hayatımızla ilgili her şeyin bir sınırı olduğunu gösterir. İlk dönemlerde vücudun birkaç iyi korunmuş kısımları veya istisna durumlarda bütün vücutlar anatomi müzelerinde teşhir edilirdi. Ancak, halk, cesetler ve onların anatomisiyle zaman içinde yüzyüze geldi. Sonuç olarak, çözümlenmemiş sorular hakkında geniş bir alan bulmak çok fazla şaşırtıcı değildir. Bunların en önemlisi, insan orijinli anatomik örneklerin yalnızca doktorlara ve tıp öğrencilerine değil, fakat aynı zamanda halkın görüşüne ne dereceye kadar sunulabilir olduğudur.

Eğer bu konuda güvenlik veya açıklığa ait kanuna bakarsak, o zaman neyin mevcut olduğu gerçeği, belirgin olan normların açık bir düzenlemesi olur. Ancak, az sayıda anatomik yasalar vardır ve onlar, vücutların tedavisiyle ilgili çok az soruya hitap ederler. Ayrıca, vücutların tedavisiyle ilgili kurallar, temel genel ilkelerden gelmek zorundadırlar. Bildiri, bu etik ve yasal kuralların bazılarını açıklar. Buna bağlı olarak, cesetlerle ilgili temel soruların incelenmesi gerekir. Onlar şunlardır: Hangi görevler vardır ve kime uygulanırlar? Bağışsız insan kalıntılarıyla ne yapacağız? İlk önce ölü vücudun statüsünü açıklamak zorundayız. Almanya ve İsviçre%u2019de herkesin ölü vücudunu, anatomiye bağışlamaya müsaade edilmesi fikrindeyiz. Prensip olarak kanun, cesetlerin veya onların kısımlarının müzeye tahsisini kabul eder. Anatomik vücutların varlığı yasal bir gerçeği bize gösterir. Anatomiye ceset bağışı üzerindeki uygulama, bir bütün olarak toplumda açıkça sorgulanan böyle bir noktaya getirdi. Bu, vücudun veya onun kısımlarının ticari ve ticari olmayan kullanımı üzerindeki büyüyen spektruma yansır.

İnsan artıklarının teşhiri ile ilgili etik sorunların başlamasından uzun zaman önce, patoloji ve anatomiye tahsis edilmiş müzeler, insan vücudunun sağlıklı ve patolojik fonksiyonu üzerine halkla karşılıklı konuşma gayesini sağladılar. Aslında, bir kimsenin vücudunu bağışlaması, vücutları anatomi enstitüsüne bağışlama geleneğinin bir parçasıdır. Bu nedenle insan kalıntıları, mal veya sahip olmanın belli özellikleriyle tartışmalı olarak sınıflandırılabilirler. Bu koşulsal sonuç, İnsan Hakları ve Avrupa Biyotıp Sözleşmesi ve insan orijinli organ ve dokuların nakli üzerindeki ek protokolle uygunluk gösterir. Her iki yasal norm, insan kalıntılarının ticari kullanımını yasaklarlar. Ancak, cesetle ilgili mülkiyet hakkını yasaklamazlar.

Bununla beraber mülkiyet kanunları gereğince, cesedin statüsünü açıklamak, bir insan cesedinin mülkiyet konusu ele alındığında ikna edici değildir. Mesela, mülkiyet sahipliği, mal sahiplerinin hakkıyla beraberdir. Ölen kişi, artık kendi hakkı açısından bir kişi olarak düşünülmemesine rağmen, hayatları boyunca kazandıkları bazı legal haklar ölüm şartlarına bağlı olarak, hâlâ belli bir süre için öldükten sonra da kalır. Ölümün ötesinde insanın öneminin devamlılığı, cesetler ve insan artıklarının nesneler olduğu anlamını verir, onlar genelde mal olarak düşünülmezler.

Bunun ışığında, cenazesinin yeri ve tipi ile ilgili ölen kişi tarafından verilen kararlar önemlidirler ve Avrupa Biyoetik Sözleşmesi, organ bağışını öncelikle ölen kişinin onayına bağlar. Eğer yazılı veya diğer bir şekilde onay verilmemişse, en yakın akrabanın onayı veya ölen kişinin yetki verdiği kişilerden talep edilir. Ancak, ölen kişinin tahmin edilen arzusu, bilindiği şekliyle göz önüne alınır. Her halde, yasa etik bir minimuma bir şeyi eşitlemeye müsaade ettiği için, tartışma çoğunlukla bu noktada son bulmaz. Hakkı ve doğruyu belirten etik, yazılmış ve yazılmamış kuralların önünde gelir. Hukuk ve etik, birbirlerini tamamlarlar ve birbirlerine gereksinim duyarlar. Bununla beraber, anatomik örneklerin nasıl işlemden geçirilmesi hususunda geniş ölçüde değişen fikirler vardır. Bizim kabul etmek zorunda olduğumuz şey, bütün yasal kararların etiğin minimumu olarak isimlendirileni tanımlamaktır. Gerçek etik, bu sınırların ötesine gider.

DER NICHTEINWILLIGUNGSFÄHIGE PATIENT - ETHISCHE PROBLEME EINER VORAUSVERFUGUNG

Die Möglichkeiten der modernen Medizin haben es mit sich gebracht, dass menschliches Leben, das in früheren Zeiten aufgegeben werden musste, heute oftmals erhalten werden kann. Damit ist jedoch verbunden, dass Menschen heutzutage Angst davor haben, am Ende ihres Lebens mit diagnostischen und vor allem therapeutischen Maßnahmen belastet werden, die ihr Sterben u. U. um Wochen oder gar Monate hinausziehen und damit auch ihr Leiden verlängern. Trotz seiner unbestreitbaren Fürsorgepflichten kann der Arzt angesichts vielfältiger Entscheidungsoptionen und vielfältiger Wertebilder für seinen Patienten nicht %u201Cdas Gute%u201D bestimmen. In diesem Zusammenhang kommt dem Begriff der Autonomie des Patienten eine besondere Bedeutung zu, und es stellt sich in der Praxis vielfach die Frage, in welcher Weise der Wunsch des Menschen nach einem gelingenden Leben, das ein selbstbestimmtes Sterben einschließt, respektiert werden kann. Das Instrumentarium einer Patientenvorausverfügung soll Richtlinien für die medizinische Versorgung eines Patienten in zukünftigen Lebenssituationen beschreiben, in denen die Entscheidungs- und / oder Kommunikationsfähigkeit verloren gegangen ist. Damit soll die Patientenverfügung dazu dienen, den Respekt vor der Autonomie des Patienten zu gewährleisten. Dennoch sind die Entscheidungssituationen oftmals recht belastet, da der Patient nicht mehr entscheidungs- und einwilligungsfähig ist und Dritte seinen Willen zum Ausdruck bringen müssen. Auch der einwilligungsunfähige Patient hat das Recht mithilfe seiner Vorausverfügung eine Behandlung abzulehnen. In der Debatte um die Verbindlichkeit von Vorausverfügungen und der Ablehnung von lebenserhaltenden Behandlungsmaßnahmen hat sich gezeigt, dass es zur angemessenen Umsetzung des Patientenwillens von besonderer Bedeutung ist, wenn der Betroffene zu wesentlichen und häufig sehr umstrittenen Wertentscheidungen eine Aussage gemacht hat. Dazu gehören vor allem die ganz individuelle Bedeutung des Verlusts der Kommunikationsfähigkeit, die Empfindungen persönlichen Würdeverlusts, die Bedeutung des Verzichts auf Ernährung und Flüssigkeitszufuhr und die Bedeutung von Fürsorglichkeit und Selbständigkeit im eigenen Leben. Die Unsicherheiten über die Gültigkeit von Behandlungsbegrenzungen in Patientenverfügungen können auf diese Weise erheblich reduziert, wenn nicht sogar vermieden werden. Damit entfällt auch die Möglichkeit, den in schriftlicher Form zum Ausdruck gebrachten Willen des Patienten durch eine gemutmaßte Rücknahme in Frage zu stellen.

DECISIONAL INCAPACITY %u2013 ETHICAL PROBLEMS OF ADVANCE DIRECTIVES

Modern medical technologies allow to safe human lives, which could not be sustained some decades ago. This implies however that nowadays people fear to be vexed and burdened with diagnostic or therapeutic procedures at the end of their lives: their suffering and dying may be prolonged for weeks or even months. The physician%u2019s obligation is to confer benefits, to remove harms and maximize the patient%u2019s welfare. But faced with multiple treatment options and varieties of values and goals of his patients he cannot define %u201Cgood life and good death%u201D for an individual. Furthermore, there is no obligation to extend human life as far as possible and individuals are the best judges of their own best interests. In this context the meaning of autonomy and autonomous decisions becomes crucial. How can the patient%u2019s individual choices concerning his life and selfdetermined dying be respected, how can the degree of authority granted to a patient%u2019s advance directive be increased? Advance directives may allow patients to provide instructions concerning their preferences and values in the case of forgoing life sustaining treatment. The patient has the right to refuse permission to any therapy, even to lifesaving treatment and for the case, that he is incompetent. The patient%u2019s right to be left alone and not to be touched without permission has be to accepted. Advance directives are an instrument to guarantee the respect for autonomy and the reliability of selfdetermined decions. Nevertheless, decision-making has often practical problems when next-of-kin (or other surrogates) find themselves in the position to serve as an interpreter of the patient%u2019s instructions. Thus, proxy or surrogate decision makers are often poor judges of the patient%u2019s wishes, advance care planning must be clear in advance about some specific and important values and advance directives should focus upon values more than upon medical treatments. Individual preferences, wishes and values as the meaning of the ability to communicate, of individual aspects of human dignity and loss of dignity, the meaning of independence and the role of artificial nutrition and hydration at the end of life (e.g., in a vegetative state or in dementia) must be explicit and detailed. In this way uncertainies and ambiguities that arise in interpreting the patient%u2019s wishes with regard to instructions refusing life supporting interventions could be reduced and the degree of stability of directives over time should no longer be called into questions.

ONAM VERME YETENEĞİ BULUNMAYAN HASTA- GELECEĞİ BELİRLEYEN ONAMA İLİŞKİN ETİK SORUNLAR

Modern tıbbın olanakları, önceki zamanlarda sonlanmaya bırakılan insan yaşamının çoğu kez sürdürülmesini beraberinde getirdi. Buna bağlı olarak insanlar, yaşamlarının sonunda tanı ve özellikle de tedavi yöntemlerinin ağırlığı altında ezilmekten, ölümlerinin haftalar hatta aylar ötesine ertelenmesiyle çekecekleri acıların uzatılacağından korkar oldular. Hekim, tartışmasız olan özen gösterme yükümlülüğüne karşın, çok yönlü karar seçenekleri ve hastalarının değer portrelerinin çeşitliliği nedeni ile hastası için %u201Ciyi%u201D olanı belirleyemez. Bu bağlamda hastanın özerkliği özel bir anlam kazanır ve uygulamada çoğu kez, hastanın, kendi belirlediği ölümü içeren muvaffak olunmuş bir yaşam arzusuna ne şekilde saygı gösterilebileceği sorusu doğar. Geleceği belirlemek üzere verilmiş onam, hastanın gelecekte karar verme ve/veya iletişim kurma yeteneği kaybolduğunda tıbbi bakımının çerçevesini çizmek için yol gösterici içerikte olmalı, böylelikle hastanın özerkliğine saygı gösterilmesine hizmet etmelidir. Öte yandan, hastanın karar verme yeteneğinde olmadığı ya da onam veremeyeceği durumlarda, karar vermek de oldukça zordur ve onam vermek üçüncü kişilere düşer. Onam veremeyecek durumda olan hasta, eğer önceden geleceği belirleyecek onam vermişse, tedaviyi reddedebilme hakkını kullanabilme olanağı bulur. Geleceği belirlemek üzere verilen onamın bağlayıcılığı ve tıbbi yaşam desteğinin reddedilmesi ile ilgili tartışmalar, bu kişilerin adı geçen onam aracılığıyla temel ve genellikle çok tartışmalı değer kararlarını ifade etmiş olmalarının büyük önemi olduğunu ortaya koymuştur. Bunlar, iletişim kaybının kendisi için değeri, onurunun zedelenmesi konusunda hissettikleri, gıda ve sıvı verilmesinin kesilmesini nasıl karşılayacağı ve kendi yaşamına özen gösterme ve yaşamını kontrol edebilmenin kendisi için anlamı gibi değerlerdir. Tedavinin sınırlandırılması isteğine ilişkin tereddütler ancak geleceği belirleyen onam verilmişse önemli ölçüde ortadan kaldırılabilir, hatta yokedilebilir. Yine böylelikle hastanın yazılı olarak ifade ettiği onayı, tahminlere dayalı olarak tereddütle karşılayıp, tartışmaya açmak gereksinimi de ortadan kalkar.

INFORMED CONSENT: HISTORICAL BACKGROUND; ACTUAL AND FUTURE PERSPECTIVES

In a preceeding lecture, presented last year at the congress of Bursa, we described the historical background of the concept 'Informed Consent' from the first clear reference in the Talmud (V th Cent.), through the phenomenon of emancipation during the period of Enlightement (XVIII th Cent.) to the Nürenberg Code of 1947 drawn up after the nazi atrocities performed on prisoners of war. This code was actualised in 1964 and his priciples extended to all diagnostic and therapeutic acts. From the last quarter of the XX th Century on until now social trends changed drastically and mankind as a whole became more focused on human rights: different countries promulgated specific 'patient-rights'-laws where the obligation of 'informed consent' is specifically mentioned.'Informed Consent' is grounded on three fundamental principles of medical ethics: the principle of 'Bonus medicus' (good physician), that of the judicious distribution of medical facilities and that of the autonomy of the patient. The juridical background is on one side the contractual character of medical liability and on the other side the penal aspect: allowed assault and battery under the specific condition of informed consent. We'll discuss different aspects of the information to be given: the content of it with special focus on the communication of risks according to their severity, their frequency and their relevance. We also give our opinion how the information has to be conferred: on as silent, verbal or written way. Thereafter we pay attention to the aspect 'consent'. Is the tendency to write a leaflet, sometimes a booklet, to obtain a written and signed consent for each medical intervention realistic in the future? Is there still a future for the typical and worthful interpersonal relationship between the physician and the patient?

Geçen yıl Bursa Kongresi%u2019nde sunulan, bundan önceki konferansta, aydınlatılmış onam kavramının, Talmut%u2019taki (5. yüzyıl) ilk açık bilgilerden gelen, aydınlanma dönemi (18. yüzyıl) sırasında serbestlik fenomeni ile, savaş mahkumlarına uygulanan Nazi zulmünden sonra oluşturulan 1947 Nuremberg Kodu%u2019na kadarki tarihsel geçmişini tanımladık. Bu kod, 1964%u2019te güncellendi ve ilkeleri tüm tanısal ve tedavisel yasalara kadar genişletildi. Sosyal eğilimler, 20. yüzyılın son çeyreğinden günümüze kadar gelişti ve bir bütün olarak insanlık, insan hakları üzerine daha çok odaklanmaya başladı: Çeşitli ülkeler aydınlatılmış onam görevinin özellikle söz edildiği özel hasta hakları yasalarını çıkardılar.

Aydınlatılmış onam, tıp etiğinin üç esaslı ilkesi üzerine dayanır: Bonus Medicus (İyi hekim) ilkesi, tıbbi kolaylıkların adaletli dağıtımı ve hasta özerkliği. Yasal geçmiş, bir taraftan tıbbi sorumluluğun sözleşme özelliğine ve diğer taraftan ceza kavramına dayanır Burada, verilen bilginin farklı yönlerini tartışacağız: Şiddetleri, sıklıkları ve ilgilerine göre risklerin iletişimi üzerine özel odaklanma ile onun içeriği. Aynı zamanda, bilginin nasıl görüşülmesi gerektiği fikrini veriyoruz: Sessiz, sözlü veya yazılı yolla olma üzerinde.

Ondan sonra, onam kavramına dikkati çekiyoruz. Gelecekte her bir tıbbi müdahale için gerçek olarak, birkaç sahifeye, bazen bir kitapçığa yazmaya, yazılı ve imzalı bir onam elde etmeye meyil mi vardır? Hasta ve hekim arasındaki tipik ve değerli kişisel ilişki için hâlâ bir gelecek var mıdır?

CHILDREN AND DEMENTIA PATIENTS %u2013 SUBJECTS OR OBJECTS IN MEDICINE?

1. The right of self-determination over one's own body is the core of human dignity and freedom. It is equally applied to healthy and diseased persons. Every intrusion into the human body requires the consent of the person concerned. This is also the case for a medical intervention which aims at healing the diseased persons or even saving their life, and is a fortiori for measures in medical science. The reason for this legal framework is to prevent the degradation of the person concerned to a mere object.

2. The right of self-determination involves personal responsibility. Hence, every legal system defines legal conditions for the exercise and acceptance of the right of self-determination. In German law the capability of self-determination is not part of the rules for legal capacity in contract law, which involves fixed age limits. What is decisive is the individual capacity of the person concerned to understand in general terms the nature, the meaning and the consequences of the measure, to balance the pros and cons, and to come to a conclusion for their own decision. Thus children and people who suffer from serious mental diseases (for instance dementia patients) are incapable of executing their self-determination in a legal sense.

3. Indeed, persons are capable of understanding and assessing in different ways and dimensions. But, the problem is that the legal question of the self-determination of the person concerned can only be answered by %u201Cyes%u201D or %u201Cno%u201D. The boundary from which a person is (already) capable of executing self-determination (for instance at the age of 14 or 16) or from which a person concerned is not (any longer) capable of executing self-determination (for instance with marginal dementia), is not fixed by German law, so that in fact the decision is conferred on the physician, albeit that the question is of a judicial nature.

4. A person who is not able to execute his/her self-determination may not be degraded to a mere object for the interest of other persons nor may he/she be deprived of essential medical aid solely due to the fact that this person is unable to make an effective decision for himself/herself. Therefore, the legal system has to establish surrogate mechanisms for the individual decision of the person concerned in order to avoid a lack of legal status for persons incapable of giving consent.

5. The most important surrogate mechanism is the legal institution of legal representation.

The decision of the representative is equivalent to that of the person concerned in legal terms. Parents are normally the legal representatives of minors. An adult can be accompanied by a legal representative who is appointed by a court (carer, %u201CBetreuer%u201D). The legal representative shall act for the well-being of the person unable to consent and shall act under consideration of his/her wishes.

6. A second surrogate mechanism is the legal institution of presumed consent. If neither the person concerned nor the representative are able to act, it is necessary to try to determine - under reasonable conditions - the assumed intention of the person concerned, i.e. the intention he/she would express, if he/she could be asked. In the case of measures which are in the best interest of the person concerned, it is assumed that the presumed consent of the person concerned does exist. The individual wishes, explanations and perceptions of the person concerned are only of importance, if the person concerned has expressed his/her individual wishes and perceptions while capable of giving consent, and if the physician is informed of the individual wishes of the person concerned (for instance from relatives). If different wishes of the person concerned, which correspond to his objective intention, are identifiable, the physician is bound by these wishes. The right of self-determination for those people who cannot express themselves, is thereby protected.

7. In spite of the surrogate mechanisms mentioned, which provide for the protection of the right to self-determination of the person who does not have the capacity to consent, the risk exists, that the person concerned will be degraded to a mere object for the interests of other persons, i.e. that he/she will be exploited (%u201Cinstrumentalisiert%u201D):

• The legal representative might possibly not act in the best interest of the person concerned or according to his/her wishes and intention. In any case the decision of the representative is an external action (i.e. the person concerned does not act for him-/herself) even if the decision of the representative is interpreted in legal terms as the decision of the person concerned.
• The presumed intention will possibly be interpreted - with or without awareness %u2013 in accordance with the wish of the acting person. Anyway, the basic principle of the presumed consent is extremely uncertain as the expressions of the person concerned made in another context need to be transferred and to the current situation and adapted.

8. The risk of the exploitation exists particularly in these cases where a measure which is not beneficial to the patient will be executed, i.e. a measure which is not in the patient's own objective interest. This applies for instance to a scientific experiment in basic research. Indeed, there is no definite boundary between measures, which are purely of external value and measures, which are (potentially) beneficial for the person concerned. Only measures which are executed exclusively for the (anticipated) benefit of the person concerned are unproblematic. This applies for medically indicated standardised therapies as well as for the trial of an individual curative treatment where no standardised treatment exists. Such medical measures comply in general with the presumed intention of the patient.

9. Medical research conducted on persons who do not have the capacity to consent involves a specific dilemma. This dilemma exists between the individual well-being of the person concerned, his/her right to self-determination and human dignity on the one hand, and the common welfare, which will be enhanced on the basis of medical progress %u2013 including potential benefits for other patients %u2013 on the other hand. If persons who do not have the capability to consent are excluded from medical research a priori, the opportunity to include this type of patients or potentially diseased persons in future medical progress is lost.

10. A society depends on solidarity in many forms. Someone who fails to render any assistance at an accident, although it would be reasonable, is even liable to be penalised. The demand for solidarity is therefore a legitimate one a priori.

11. But special protection has to be afforded to people who do not have the capability to consent. The German law therefore provides a combination of different protection mechanisms which, only when taken together as a package, guarantee a high level of protection for people who do not have the capacity to consent:

a) Objective criteria for protection

- Measures, which will (probably) not be beneficial for the person concerned, should not be excluded a priori %u2013 contrary to some current legal viewpoints. Hence, the new German Pharmaceutical Act (Arzneimittelgesetz) allows these measures to a certain extent, but only as ultima ratio. Therefore research with people who do not have the capability to consent is not permitted if the execution of such research is also possible with people who have the capacity to consent. In addition, unreasonably subjecting a patient who cannot consent to non-beneficial risks or burdens is not permitted. Consequently, the overall basic principle is the necessity of the measure.

- Solidarity can only be expected within a defined community. The execution of (potentially) non-beneficial measures for the person concerned is only allowed if these measures are of potential benefit to a group of similarly affected persons.

- The benefits and the risks have to be balanced in a responsible manner. When a measure brings no potential benefit for the person concerned, such measure may only involve minimal risk or a minimal burden.

b) Rules of procedure for protection criteria

- Adherence to the objective protection criteria has to be examined ex ante by an independent and interdisciplinary ethics committee.

- Ethics committees should in future be assigned the duty of monitoring(i.e. continuous control), in order to be able to react to the specific needs of individual patients.

c) Guarantee of autonomy in protection criteria

- The precondition for including people without the capacity to consent in medical research is the approval of their legal representative. He/she is the one who has to fulfil the task of caring for the person who does not have the capacity to consent. The legal representative is bound to decide on the presumed intention of the person concerned as far as possible, because he/she knows him/her best.

- The person concerned needs to be instructed and informed in order to enable him/her to understand the moot measure and to make his/her own decision. This is a particular duty in medical information in which the existent capabilities of the person concerned need to be %u201Cactivated%u201D. An appropriate medical information may lead to understanding and to the ability to consent.

- Even if the person concerned has not the capacity to decide by him-/herself in a legal sense, he/she has to be informed about the measure in question. Therefore the person who does not have the capacity to consent also needs to be involved in the decision-making process. Even children therefore need to be informed in a suitable way.

- The person who does not have the capacity to consent should have the right of veto, whereby any sign of rejecting the measure, which is more than a reflex, has to be considered as an expression of the individual's self-determination.

- To enable the individual reactions and wishes of the person who does not have the capacity to consent to be better expressed, a trusted third person should attend the research measure and should be allowed to halt the trial.

12. Persons who do not have the capacity to consent have to be taken seriously as the partner of the physician and the researcher as far as possible. They have to be informed according to their capacity; any behaviour signalling rejection with regard to measures of no direct benefit has to be respected. The question I posed in the title of my speech, whether children and dementia patients are subjects or objects in medicine, gives a false impression of alternatives, and gives no consideration to the gradually varying capabilities of human beings - even if the crucial question of capability of self-determination can only be affirmed or negated

ÇOCUKLAR VE DEMANS HASTALARI %u2013 TIPTA DENEKLER VEYA NESNELER?

1. Bir kişinin kendi vücudu üzerindeki irade özgürlüğü hakkı, insan değerinin ve özgürlüğünün özüdür. Bu hak sağlıklı ve hastalıklı kişilere eşit olarak uygulanır. İnsan vücüduna her müdahale o kişinin aydınlatılmış onayını gerektirir. Bu, aynı zamanda hastalıklı kişileri iyileştirmeyi ya da hayatlarını kurtarmayı gaye edinen bir tıbbi müdahale vakasıdır ve tıp ilmindeki ölçüler için fortioridir.

2. İrade özgürlüğü hakkı kişisel sorumluluğu kapsar. Bu nedenle, her hukuki sistem irade özgürlüğü hakkının pratiği ve kabulüne ait hukuki durumları açıklar. Alman hukukunda irade özgürlüğü yeterliliği, sabit yaş sınırlarını kapsayan sözleşme hukukunda yasal yeterlilik kurallarından değildir. Nitekim ciddi akıl hastalığından acı duyan çocuklar ve hastalar (mesela demans hastaları), hukuki bakımdan irade özgürlüklerini idare etme kapasitesine sahip değildir.

3. Gerçekten, insanlar farklı yollarda ve ölçülerde anlama kapasitesindedirler. Ancak, problem, ilgili kişinin irade özgürlüğüne ait hukuki sorunun yalnızca evet ya da hayırla cevaplandırılabilmesidir. Bir kimsenin irade özgürlüğünü idare etme kapasitesi (mesela 14 veya 16 yaşında) olmasından veya bir kimsenin irade özgürlüğünü idare etme kapasitesine sahip (mesela marjinal demans) olmamasından gelen sınır Alman hukuku tarafından saptanmaz. Öyleki, her ne kadar sorun hukuki tabiyatta ise de karar hekime aittir.

4. Bu sebeple hukuki sistem, onay verme yetersizliğine sahip kişilerle ilgili yasal statü eksikliğinden kaçınmak için ilgili kişinin kişisel kararı ile ilgili vekil mekanizmalar kurmak zorundadır.

5. En önemli vekil mekanizması yasal temsil etmenin hukuki kurumudur. Temsilcinin kararı hukuki durumlarda kişininkine eşittir. Ebeveynler normal olarak küçüklerin yasal temsilcileridirler. Bir yetişkin, mahkeme ile atanan yasal bir temsilciyle temsil edilir. Yasal temsilci onay verme yetersizliğinde olan kişinin iyi olması için çalışacaktır ve isteklerini dikkate alacaktır.

6. İkinci bir vekil mekanizma varsayılan onayın hukuki kurumudur. Eğer kişi, ne ilgili kişi, ne de temsilci davranış yeterliliğinde değillerse o takdirde mantıklı durumlar altında ilgili kişinin tahmin edilen maksadını tespit etmeye çalışmak gereklidir. İlgili kişinin şahsi istekleri, açıklamaları, eğer ilgili kişi onay verme kapasitesine rağmen isteklerini açıklıyorsa ve eğer hekim ilgili kişinin kişisel isteklerinden haberdarsa önem taşırlar. Eğer objektif gayeye hitap eden kişinin farklı istekleri ayrılabilirse hekim bu istekleri saptar. Kendi kendilerine açıklama yapamayan bu insanların irade özgürlüğü hakkı bu suretle korunur.

7. Onay verme kapasitesine sahip olmayan kişinin irade özgürlüğü hakkını korumayı sağlayan sözü edilen vekil mekanizmalarına rağmen ilgili kişinin, diğer kişilerin yararları için önemsiz bir obje olarak zarar göreceği risk vardır.

8. Sömürme riski, hastaya yararlı olmayan bir kanunun bulunacağı bu vakalarda özellikle vardır. Bu, mesela, temel araştırmadaki bilimsel deneğe uygulanır. Gerçekte kişiye yararlı olmayan dış değerde olan kanunlar ve kişiye yararlı olan kanunlar arasında tam bir bağ yoktur. Kişinin yararına olarak uygulanan kanunlar problemli değillerdir. Bu, standardize edilmeyen tedavinin bulunduğu kişisel yararlı tedavi denemesi kadar tıbbi endikasyonu olan standardize tedavilere de uygulanır. Böyle tıbbi yasalar hastanın varsayılan maksadıyla uyumludurlar.

9. Onay verme kapasitesine sahip olmayan kişilere uygulanan tıbbi araştırma özel bir ikilemi meydana getirir. Bu ikilem, bir taraftan kişinin kişisel iyi olması, irade özgürlüğü hakkı ve insan değeri, diğer taraftan tıbbi ilerlemenin temelinde bulunacak olan diğer hastaların da potansiyel yararlarının bulunduğu genel refah arasında mevcuttur. Eğer onay yeterliliğine sahip olmayan insanlar tıbbi araştırmadan çıkarılırlarsa, bu hastaları veya potansiyel hastalıklı kişileri dahil etme fırsatı kaybolur.

10. Özel koruma onay yeterliliğine sahip olmayan kişilere uygulanmak zorundadır. Bu nedenle Alman hukuku, bir paket olarak alındığı zaman onay kapasitesine sahip olmayanlar için yüksek düzeyde bir koruma garantisi veren farklı koruma mekanizmalarının bir kombinasyonunu sağlar.

11. Onay verme kapasitesine sahip olmayan kişiler, araştırıcı ve hekimin partneri olarak ciddi olarak ele alınmak zorundadırlar. Kapasitelerine göre bilgilendirilmek zorundadırlar; direkt olarak yararı olmayan kanunlarla ilgili reddetme işareti veren herhangi bir davranışa saygı duyulması gerekir.

TIPTA NORM ÜRETME ETKİNLİĞİ; DEONTOLOJİ %u2013 ETİK İLİŞKİSİ

Günümüzde teknik, bilimsel, düşünsel ve kültürel alanlarda meydana gelen değişimler, daha önce üzerinde anlaşmaya varılmış normların yetersiz kalmasına ve yeni tartışma alanlarının oluşmasına yol açmaktadır. Bu durum bir çok alanda belirsizliklere neden olmaktadır. Yürürlükte bulunan yasal düzenlemelerin yetersiz kaldığı ve etik açıdan ele alınmasını gerektiren durumların yanısıra; yeni ortaya çıkan durumlar (%u201Crealite%u201D) karşısında yeni normlar üretme ihtiyacı da hissedilmektedir. Kuşkusuz yaşanmakta olan yeni durumlar, o durumlarda yol gösterici yeni kurallara ihtiyaç yaratır. Hemen hemen bütün toplum düzenlerinde ve bütün sosyal yapılarda genel ihtiyaçların bir kurala dönmesi bir zorunluluktur. Normatif etkinliğin rasyonel bir biçimde işleyebilmesi için bu sistemlerin yapı ve işlevleri hakkında genel yaklaşımlardan haberdar olmak gereklidir. Bu durum aynı zamanda akılcı, mantıklı ve tutarlı bilgilere sahip olmayı da gerektirmektedir. Tıbbi deontolojinin kaynağını oluşturan tıbbi etik çalışmaları sırasında yapılan iş de kısaca budur. Etik, açık uçlu bir takım soruları ve sorunları irdelerken ve bazı sonuçlara varmaya çalışılırken başvurulması gereken bir alandır. Etik norm üretme etkinliklerinin sonuçları oldukça önemlidir; çünkü bu sonuçlar kaçınılmaz bir biçimde deontolojinin kaynağını oluştururlar. Bu sunumun amacı; genel olarak tıbbın normatif yönleri üzerinde durmak, tıp hukuğu alanının tıptaki gelişmeleri izlemekteki güçlüklerini vurgulamak ve etik açıdan yetersiz kalınan noktaları da belirlemektir.

NORMATIVITY IN MEDICINE; MEDICAL ETHICS / DEONTOLOGY

It is an obvious fact that the medical science has increased its scientific knowledge content in a short period of time. In one hand this situation happens to widen the details of medical data in the greatest possible, on the other hand it causes important spaces in the normative field of medical science. Especially, while the technical and scientific developments in medicine fastly increase the number of the %u2018possible to does%u2019 in daily applications, norms that constitute to the content of madical law and comprehenced in a traditional way, gradually remains insufficient. At this point of view, applications that newly entered to the medical field, before all else has to interrogate extremely comprehensive and evaluated. Because creating the new rules that fit to that area, can only be possible after these kind of intellectual discussions. Making these kind of discussions and then reaching the norms that is peculiar to that area, make these norms also functional. Thus both medical universe and the humanity itself can decide in which provisions and how will the attempts come to life; and if only in which condition it becomes good or reasonable. This decision symbolizes the texts, generally starting from the science world or more generally mankind%u2019s consience, which humanity commonly agreed. The normative aspect of medicine and the relations between the fields of ethics and deontology will be main themes of this presentation.

ETİK AÇIDAN BİREYSEL İNTİHAR KARŞISINDA HEKİM

Her canlı, ölmek zorundadır ve bundan ötürü ölüm, insanın doğasına ait bir olgudur. Ancak, canlılık sürecinin doğal seyrini izleyerek sona ermesi demek olan %u201Cdoğal ölüm%u201D sınıflandırması yanında, doğal ömrün beklenmedik bir zamanda sona ermiş olduğunu ifade eden %u201Cdoğal olmayan ölüm%u201D sınıflandırması da bulunmaktadır. %u201CDoğal olmayan ölüm%u201D tanımı, içerisinde bu tür ölümlerin engellenebileceği, hatta engellenmesi gerektiği savını da barındırır. İntihar da, doğal olmayan ölüm sınıflandırmasına giren olgulardandır. Temel çelişki tam da bu noktada belirir. İntihar, engellenebilecek ya da mutlaka engellenmesi gereken bir eylem midir? İntihar sürecinin her noktasında geri döndürme yönünde çaba gösterilmesi gerekli midir?Avusturyalı filozof Jean AMERY, 1976 yılında yayınladığı ve intiharın önlenmesi yükümlülüğünü radikal biçimde tartışmaya açtığı %u201CHand an sich legen%u201D eserinde intiharın, %u201Cinsanın yaşamak zorunda olduğu%u201D şeklindeki doğa kuralının çiğnenmesi olduğunu söyler ve sorar: %u201Cİnsan yaşamak zorunda mıdır?%u201D Araştırmacıların çoğu, intihara kişinin geçerlilik taşıyan kararının değil, daha çok sorunu uygun biçimde çözme yeterliliğini yokeden bir ruhsal tablo içine girmesinin yol açtığını savunurlar. Ancak intiharların büyük oranda hastalık tabloları dışında, sağlıklı insanlarca gerçekleştirildiğini ortaya koyan, yeterli sayıda yakın tarihli araştırma da bulunmaktadır. İntihar girişimi karşısında hekim ve diğer sağlıkçılar, tıp etiğinin özerklik ilkesi ve yarar sağlama ilkeleri açısından yanıtı zor sorularla yüzleşmek zorunda kalırlar. Tıp etiğinin özerklik ilkesi gereği hekim, ancak hastasının onay vermesi koşuluyla yaşamı koruma bilgi ve becerisini onun için kullanabilme hakkına sahiptir. Öte yandan mesleki rolü, yararlılık sağlama üzerine kurgulanmıştır. Şimdi ise karşısında tıbbi yardımı aramak, istemek bir yana, yaşamdan tümüyle kopmaya çaba göstermiş bir kişi (intihar girişimcisi) durmaktadır. Tıp etiği açısından sorun, hekim olarak yardım etme yükümlülüğünün sınırlarının tanımlanmasındadır. Gelişmiş Batılı ülkelerde intihar olguları karşısında hekime giderek daha fazla hareket alanı tanıma yönünde bir tutum değişikliği de gözlenmektedir.İntihar eylemi karşısında etik bir tutum takınabilmek için, intiharın özgür düşünceyle verilmiş bir kararın sonucu mu, yoksa çaresizlik duygusu içinde etkili bir %u201Cyardım çığlığı%u201D atabilmek için başvurulmuş bir eylem mi olduğunun aydınlatılabilmesi gerekir. Eğer intihar girişiminde bulunan, bu girişimi aracılığıyla yaşamdan gerçekten kopmayı istememiş, sadece etkili bir yardım çağrısında bulunmak istemişse, hekim yardımına gereksinim bulunduğu ve hekimin bu yardımı sunması gerektiği tartışmasız olarak kabul edilmektedir. Özerk kararın ürünü olan ya da terminal dönemde gerçekleşmiş intihar girişimlerine derhal tıbbi müdahalede bulunmak, etik açıdan kolay savunulabilecek eylemler değildir. Ancak özerk kararın ürünü olarak girişilmiş bir eylemin içerisinde, kişinin kararından vazgeçerek yardım istediği, ama bu yardımı ifade edemediği durumlar da olabileceği gözönünde bulundurulmalıdır.Hekim, intihar girişiminde bulunmuş olanın yanına çağırıldığında, çoğu kez sözkonusu kişinin bilinci kapalıdır. Zaman baskısı altında hekimin, %u201Cintihar özerk bir seçim mi?%u201D sorusunu aydınlatma olanağı bulunmaz. Zaten, hangi kararın gerçekten özerk/istemli, hangi kararın ise özgür olmayan/istemsiz karar olduğunu kesin olarak ayırdetmek de aslında pek mümkün değildir. İntihara meyilli olan ( intihar girişiminde bulunma riski taşıyan ya da böyle bir girişimde bulunmuş ve böylelikle yeni bir girişimde bulunma riski artmış) kişilerin korunması konusunda hekimin hukuki ve etik sorumluluğu da geniş olarak tartışılmaktadır. Hekim ve diğer sağlık görevlilerinin tamamlanmamış intihar olgularına olumlu duygularla yaklaşmadıklarını ortaya koyan araştırma sonuçları ise oldukça düşündürücüdür.Hekim ve sağlık çalışanları, %u201Cölüm%u201D korkuları ile yüzleşmelidirler. Bu yüzleşme gerçekleşmeden, insanları yaşamda tutmak için sınırsız yardım etme yükümlülüğü bulunmadığı üzerinde düşünme şansımız olmaz. %u201CTıp ve Ölüm%u201D kavramları birbiriyle barışmadan, %u201CTıp ve İntihar%u201D kavramları da birbiriyle barışmayacak, sürüp giden yadsıma, sorunların ele alınmasını güçleştirecektir.

ARZT UND INDIVIDUELLER FREITOD AUS ETHISCHER SICHT

Jedes Lebewesen ist sterblich, weshalb der Tod Teil auch der menschlichen Natur ist. Neben der Kategorie des "natürlichen Todes", unter dem das Ende des Lebens in seinem natürlichen Verlauf verstanden wird, existiert die des "unnatürlichen Todes", die ein unerwartetes Lebensende impliziert. Die Definition "unnatürlicher Tod" birgt in sich bereits die These, solche Tode seien vermeidbar oder sollten gar verhindert werden. Der Freitod ist einer der Umstände, der in die Kategorie "unnatürlicher Tode" fällt. Hier tut sich ein Grundwiderspruch auf. Ist der Freitod ein vermeidbarer oder gar zu verhindernder Akt? Ist es notwendig, an jedem Punkt des zum Freitod führenden Prozesses die Umkehr zu betreiben? In seinem 1976 erschienenen Buch, das die Verpflichtung zur Verhinderung eines Freitods radikal zur Diskussion stellte, erläutert der österreichische Philosoph Jean AMERY, %u201Eder Freitod verstoße gegen die Naturregel der Verpflichtung zum Leben%u201C, und fragt, %u201Eob der Mensch denngezwungen sei zu leben?%u201C. Die meisten Forscher sind der Auffassung, der Freitod sei weniger bewusster Entschluss eines Menschen als vielmehr Ausdruck eines seelischen Zustandes, der die Fähigkeit, ein Problem in angemessener Weise zu lösen, auslösche. Allerdings existieren ausreichend Studien jüngeren Datums, die belegen, dass der Freitod meist nicht aus einem Krankheitsbild heraus, sondern von gesunden Menschen gewählt werde. Angesichts eines Freitods sehen sich Ärzte und anderes medizinisches Personal Fragen gegenüber, deren Beantwortung hinsichtlich der medizinethischen Grundsätze der Patientenautonomie und des Nutzenbringens schwer fällt. Dem medizinethischen Grundsatz der Patientenautonomie entsprechend hat ein Arzt nur unter der Bedingung der Einwilligung des Patienten das Recht, seine Kenntnisse und Fähigkeiten zur Lebenserhaltung an ihm anzuwenden. Andererseits beruht sein Berufsbild darauf, Nutzen zu bringen. Nun jedoch sieht der Arzt sich einer Person (dem Freitod-Kandidaten) gegenüber, die, weit entfernt davon, um medizinische Hilfe zu ersuchen und zu bitten, sich darum bemüht hat, gänzlich aus dem Leben zu scheiden. Aus Sicht der medizinischen Ethik besteht das Problem in der Definition der Grenzen der ärztlichen Verpflichtung zur Hilfeleistung. In den westlichen Industrieländern ist eine Haltungsänderung dahingehend zu beobachten, gegenüber suizidalen Handlungen dem Arzt einen zunehmend größerer Handlungsspielraum zuzugestehen.Um dem Freitod gegenüber eine ethische Haltung einnehmen zu können, gilt es zu klären, ob es sich hierbei um die Folge eines Entschlusses aus freiem Willen handelt oder um einen als wirkungsvollen "Hilferuf" gemeinten Akt der Verzweiflung. Wollte die Person, die Hand an sich legt, durch diese Handlung nicht wirklich aus dem Leben scheiden, sondern einen effektiven Hilferuf aussenden, ist zweifellos davon auszugehen, dass ärztliche Hilfe vonnöten ist und der Arzt diese Hilfe auch zu leisten hat. Unmittelbare medizinische Eingriffe bei suizidalen Handlungen jedoch, die aus freiem Entschluss heraus oder in der Terminalphase unternommen werden, sind aus ethischer Hinsicht nicht leicht zu rechtfertigen. Es ist zu berücksichtigen, dass auch im Laufe einer Handlung aus freiem Entschluss die Person es sich noch anders überlegt und um Hilfe bitten möchte, diese Bitte jedoch möglicherweise nicht zum Ausdruck bringen kann.Wird der Arzt zu einer Person gerufen, die suizidale Handlungen vorgenommen hat, ist diese Person zumeist nicht bei Bewusstsein. Unter Zeitdruck hat der Arzt kaum die Möglichkeit, die Frage zu beantworten, ob es sich um einen Selbsttötungversuch aus freiem Entschluss handelt. Ohnehin ist es kaum möglich, eindeutig zu unterscheiden, welcher Entschluss tatsächlich autonom/aus freiem Willen getroffen wurde, welcher hingegen unfreiwillig/ungewollt.Auch hinsichtlich des Schutzes von suizidgefährdeten Personen (also Personen, die das Risiko eines Selbsttötungsversuches tragen oder bereits einen solchen unternommen haben und deshalb ein erhöhtes Risiko eines erneuten Versuchs aufweisen) wird die rechtliche und ethische Verantwortung des Arztes breit diskutiert. Forschungsergebnisse, denen zufolge Ärzte und medizinisches Personal missglückten Suizidversuchen kaum mit positiven Gefühlen gegenüberstehen, geben zu denken.Arzt und medizinisches Personal müssen sich der Furcht vor dem Tod stellen. Solange eine solche Auseinandersetzung nicht stattfindet, können wir nicht darüber nachdenken, ob eine uneingeschränkte Pflicht zur Hilfeleistung bei der Lebenserhaltung möglicherweise gar nicht existiert. Solange die Begriffe "Tod" und "Medizin" nicht miteinander versöhnt sind, werden auch die Begriffe "Medizin" und "Freitod" nicht versöhnt sein, und die Aufrechterhaltung des Tabus wird die Lösung der Probleme nur erschweren.

Sağlıklı olmak, fizik, mental ve psişik olarak iyi olma halidir. Beden fonksiyonlarının, mental ve psişik yapının uyum içinde olması %u2018Homeostasis%u2019 olarak tanmlanır. Vücudun denge hali olan bu durumun sürdürülmesi vücut sıvısının kapsamına bağlıdır.

Aslında tüm canlılar su içinde yaşamaktadırlar. Hayatın başladığı fetal hayatta yaşamsal faaliyetlerimizi, rahimde suyun içinde sürdürürüz. Doğduğumuzda vücudumuzun % 90-95%u2019i sudur. Yaşlandıkça bu oran % 70-80 lere düşer. Sahip olduğumuz yaklaşık 50 trilyon hücre içi su dolu keseciklerdir ve hepsi hücreler arası sıvı içinde faaliyetlerini sürdürürler. Bu faaliyetleri dışardan bedene alınan oksijen, şeker, protein ve vücudun kendi ürettiği birtakım hormonları kan yoluyla hücrelere taşıyarak gerçekleştirir.

Hücre içi, hücrelerarası ve kan damarlarındaki sıvılar sanki ayrı bölgelerde yerleşmiş gibi görünseler de bu sıvıların birbirleriyle madde alış-verişleri kolaylıkla olmaktadır. Vücut sıvısının her canlı için özl bir terkibi vardır. Solunumla alınan gazların yapısı, yediğimiz, içtiğimiz besinler ve stres bu sıvının terkibinin bozulmasına yol açar. Solunumla, yiyerek ve içerek aldığımız her türlü şey bu sıvının içinde yerini alır.

Stres altında beyin hücrelerinin ürettiği moleküller, bu sıvının terkibinde rol oynar. Hücrelerin normal çalışma ortamının bozulması onların normal fonksiyonlarını etkiler. Bu sıvının terkibinin uzun süre bozuk kalması hücrelerin anormal davranışlar göstermesine neden olur. Bu da bağışıklık sisteminin kontrolü altında olan birçok faaliyetin bozulmasına ve hastalıkların oluşmasına yol açar.

Being healty is the condition of being well physically, mentaly and psychologically. Harmony of body functions and psychologic structure is defined as %u2018Homeostasis%u2019. Protection of this condition, which is a balance of body, depends on the contents of body fluid.

In fact, all creatures live inside the water. During the fetal life, where the life starts, we keep our life functions in uterus inside the water. When we born, 90-95 % of our body consists water. This rate decreases to 70-80% as we get older. 50 trillions of cells that we have are sacculers with water inside and all of them keep on continuing their functions in intracelluler liquid. They fulfill their functions with some hormons which are produced by body and oxygen, glucose, protein that came from outside to the body by carrying in the vascular system

However, inter/intracellüler and intravasculer liquids seem as taking place in different compartment, they interchange matters and liquids easily with each other. This body fluid has got a special combination in every kind of creature. Gases that we inhale, foods that we eat and stress may change this combination. Everything that we inhale, eat and drink takes place in this body fluid.

However, stress plays a role by making some molecules that are produced in brain cells and may change the concept of this liquid. Destruction of the normal conditions of cells effect their own normal functions and if the conditions of destruction continue for a long time, it makes the cells behave in an abnormal way. Also this causes impairment of some functions under immun system and makes some disease appear.

Ölüm varlık alemine gelen ve yaşayan bütün canlıların kaçınılmaz sonudur. Farklı disiplinlerden pek çok düşünür çağlar boyu ölüm üzerine fikir üretmiş, onun mahiyeti ve eğer varsa, ötesi hakkında görüşler ileri sürmüştür. Tıp uygulaması içerisindeki her profesyonelin gerek ölüm süreci gerekse ölüm anı üzerinde bir görüş sahibi olması varsayımından yola çıkan bu çalışmamız, son dönemin popüler kavramı olan %u201Cbeyin ölümü%u201Dnü ele alarak bunun gerçekten %u201Cmutlak ölüm%u201D anlamına gelip gelmediğini ortaya koymaya çalışmıştır.

İncelediğimiz tıp, felsefe ve ilahiyat kaynakları bize, %u201Cbeyin ölümü%u201Dnün %u201Cmutlak ölüm%u201De eşdeğer olmadığını, sadece kişinin ölü %u201Ckabul edildiği%u201D, dolayısıyla beyin ölümü gerçekleşmiş kişilerden yapılan organ naklinin aslında canlıdan organ naklinin farklı bir türü olduğunu göstermiştir.

WARM FACE OF DEATH: ORGAN TRANSPLANTATION IN BRAIN DEATH

Death is the inescapable end for every living being that comes to the world of existence and lives. Many scholars from different disciplines have speculated for centuries on its nature and its beyond, if there is any. By presupposing that every professional in health care practice should have a view on both dying process and the moment of death, we examined the popular concept of %u201Cbrain death%u201D in this study to find out whether it could be equated with %u201Cabsolute death%u201D.

Our literature review on medicine, philosophy and theology has proved that, %u201Cbrain death%u201D cannot be equated with %u201Cabsolute death%u201D, it only %u201Cassumes%u201D the individual as death, and therefore, organ transplantation in brain death is, in fact, a different form of organ transplantation from a living donor.

TÜRKİYE%u2019DE BİYOETİK: BAŞARISIZLIĞA GİDEN GARANTİLİ YOLLAR

Son zamanlarda yayınlanan bazı çalışmalar ve kimi gelişmeler Türkiye%u2019de biyoetiğin artık %u201Cyeni gelişmeye başlayan%u201D bir alan olmaktan çıkıp, geçmişi olan bir alan haline geldiğine işaret etmektedir. Bu durumda bir yandan biyoetik alanında belirli bir gelişmişlik düzeyine varmış olmanın haklı kıvancını yaşarken, öte yandan henüz ilk adımlarını atmakta olan bir disiplin olmanın sağladığı bazı ayrıcalıklara ve hoşgörüye de veda etmek gerekmektedir.

Bugün bulunduğumuz noktada ülkemizdeki biyoetik çalışmalarının ve eğitiminin kapsamlı bir değerlendirmesini yapmak, bu değerlendirmeden elde edilen sonucu biyoetik alanında ülkemizden daha önce yola çıkmış ve bugün daha ilerde bulunan ülkelerle karşılaştırmak, ve varolan eğilimlerden yola çıkarak geleceğe yönelik kestirimlerde bulunmak gerekmektedir. Bu gereksinimi hissetmiş olan biyoetikçiler, başta alanımızda uygulanan eğitim programları olmak üzere, ülkemizdeki genel tabloyu ortaya koymaya yönelik çalışmaları başlatmışlardır. Her ne kadar bu çalışmalar henüz sonuçlanmamışsa da genel bir kanı oluşturacak düzeyde veri elde edilmiştir.

Ülkemizde biyoetik disiplininin sağlıklı gelişebilmesi için, aynı yoldan daha önce geçmiş olanların deneyimlerinden yararlanmak, hatalarından dersler çıkarmak önemlidir. Bu sunumda, alanımızda ülkemizde gözlediğimiz eğilimlerden ve toplanmış bulunan verilerden yola çıkılarak, disiplinimizin geleceğine ilişkin sakınılması gereken yönelimlerle desteklenmesi gereken çabaların ortaya konulması amaçlanmakta olup, biyoetiğin Türkiye%u2019deki geleceğine ilişkin bir öngörüye ulaşmaya çalışılacaktır. Kuşkusuz farklı ülkelerde disiplinimizin başarılı bir biçimde gelişmesini sağlayan unsurlarla onun gelişmesine ket vuran unsurların ülkemizde de aynı biçimde ortaya çıkacağı ve aynı etkiyi göstereceği savunulamaz. Bu nedenle özellikle başarısızlığa giden garantili yollar üzerinde durulacaktır.

BIOETHICS IN TURKEY: ROADS GUARANTEED TO FAILURE

Recent publications and some events indicated that bioethics in Turkey is no longer a %u201Cnewly launched area%u201D, but rather an area with a history. In this case, we have every right to take the pride of this certain level of development on the one hand, but we have to say our farewells to the privileges and tolerence acknowledged to a discipline in her baby steps on the other.

A comprehensive analysis of the bioethics education and studies seems necessary. This analysis should be followed by a comparison of the results with the data of other countries and projections to the future according to the existing trends. Feeling this necessity, bioethicists in Turkey have initiated research in order to reveal the general picture of our discipline, especially on the bioethics curriculum in Turkey. Although these research haven%u2019t been resulted yet, there are enough data to reach to a general opinion.

In order to ensure a healthy development in our discipline, it is crucial to make use of the experience of other countries that have taken the same path and to learn from their mistakes. In this presentation, the trends which should be avoided and the efforts that should be encouraged will be revealed for a better future for bioethics as an academic discipline. A projection to the future of bioethics in Turkey will be attempted by using the available data and the trends observed in the discipline. Undoubtedly, the development of bioethics in other countries and the facts affected to this process both positively and negatively will not be the same in Turkey. This is the reason why in this presentation I will focus on the roads guaranteed to the failure.

TÜRKİYE%u2019DE CEZA HUKUKU ALANINDA YAPILAN YAKIN TARİHLİ DÜZENLEMELERDE TIP HUKUKUNA İLİŞKİN BİRKAÇ SORUN

Ülkemizde uzun süredir yapılan reform çalışmalarının önemli bir kısmı tamamlanmış ve daha önceki tasarılardaki hükümlerde yapılan çeşitli değişikliklerle kod niteliğindeki temel kanunlar yerine yeni kanunlar yapılarak yürürlüğe sokulmuştur. Önemli bir kısmı ceza hukuku alanına ilişkin olan bu geniş kapsamlı yasal düzenlemeler tıp ceza hukukunu ilgilendirmektedir. Bu çalışmada, zaman ve yer açısından imkân olmadığı için, bu yeni yasal değişikliklerden sadece bir kısmı ele alınacaktır. İncelenecek olan yasal düzenlemeler, bu yeni ceza hukuku sisteminin getirdiği ve çeşitli açılardan sorunlara yol açacak olanlardır. Öncelikle belirtmek gerekir ki, bu düzenlemelerin bir kısmı daha önceki mevzuatımızda bulunmayan ve Türkiye için ihtiyaç olan konulara ilişkindir. Örneğin insan üzerinde deney, reçeteler, hastayı aydınlatma yükümlülüğü, tedaviyi red, açlık grevleri ve zorla beslemeye ilişkin tıbbi müdahale vb.ları burada belirtilebilir. İlke olarak bu düzenlemelere yer verilmesi yerinde olmuştur. Esasen, bu kanunlara dayanak teşkil eden ve yıllardır üzerinde çalışılan kanun tasarılarında da bunların önemli bir kısmına yer verilmekteydi. Ancak bu düzenlemeler, gerek yeni getirilen kurumların düzenleniş biçimlerinin hatalı olması, eksik ve yanlış düzenlenmeleri, gerek ulusal ve ulusal üstü hukuk metinlerine aykırı bulunmaları, gerekse yapılan düzenlemelerin bir kısmının bizatihi soruna yol açacak nitelikte bulunmaları, içerisinde çelişkiler içermeleri, tıp ve ceza hukukunun temel ilkeleri ve çağdaş gereksinmelerine cevap vermek bir yana daha önce mevcut olmayan bir çok sakıncaya yol açabilecek niteliktedirler. Bu yeni yasal düzenlemelerin bir kısmı, Türkiye%u2019nin de dahil olduğu ve Tıp Ceza Hukuku%u2019nu ilgilendiren uluslararası sözleşmelere aykırı nitelik taşıdığı gibi, bu sözleşmelerin Türk devletine yüklediği yükümlülükleri karşılamaktan uzak, eksik ve yanlışlıklarla doludur. Kaldı ki bunların, aşağıda niteliklerine işaret edilenlerin bir kısmı Anayasa%u2019ya aykırı ve/veya Anayasa%u2019nın gereklerini karşılamaktan uzak niteliktedirler. Örneğin Avrupa Biotıp Sözleşmesi ve Avrupa Dopingle Mücadele Sözleşmesi hükümlerine aykırılıklar ve buna benzer sözleşmelerin gerektirdiği düzenlemelerin eksikliği önemli sorunlara neden olacaktır. Bu bağlamda, yeniden çağdaş tıp ve ceza hukukunun gerektirdiği biçimde düzenlenmesi gereken birkaç husus örnek olarak zikredilecek olursa; yeni gen tekniklerinin kullanılması, insan üzerinde deney, doping kullanımının yasaklanması, aktif ve pasif ötenazi, ilaç hukuku alanı ve kürtaj eylemleri belirtilebilir. Bu kanun metinlerinden bazıları ceza muhakemesi hukuku açısından önemli sakıncaları ve eksikleri içermektedir. Bu konuda yeni Türk Ceza Kanunu ile Ceza Muhakemesi Kanunu%u2019ndan örnekler verilecek olursa; çocuklar, akıl hastaları, alkol ve uyuşturucu madde kullananlar hakkındaki yeni yasal düzenlemeler, güvenlik ve tedavi önlemleri, genital muayene, meslek sırrı, çocuklar üzerinde deney, adam yaralama eylemlerine ilişkin düzenlemeler belirtilebilir. Yine bu yeni düzenlemeler, ceza hukuku ve tıp ceza hukukunun temel ilkelerine aykırı, eksik ve mevzuatla çelişkili yeni suç tipleri içermektedirler. Bu alandaki hatalı düzenlemelerin bulunduğu konulara işaret edecek olursak; tanıklıktan çekilme, DNA Bankalarının oluşturulması, fiziki kimlik tespitine ilişkin veri kayıtlarının ve kişisel verilerin imhası, bilirkişilik, beden muayenesi, temel tıbbi müdahaleler için yetkili makam ve susma hakkı-nemo tenatur ilkesi, çeşitli suçlarda tıp hukukuna ilişkin cezaya etkili nedenler, ihmal niteliğindeki eylemlerle işlenen suçlara ilişkin genel hükümlerin etkisi ve yardım etme yükümlülüğünün ihlâline ilişkin yeni yasal düzenlemeler gösterilebilir. İlke olarak hukukumuzdaki bazı boşlukların doldurulmuş olması yerinde olup, hatta geç bile kalınmıştır. Ancak yukarıda sadece bir kısmına değinilen yeni düzenlemelerdeki eksiklikler giderilmezse, yanlış hükümler kaldırılmazsa, hatalı ve çelişkili düzenlemeler yeniden formüle edilmezse ve yeni kanuni düzenleme yapılarak hukuksal koruma altına alınması gerekli hususlar, uluslararası hukuk ve anayasaya uygun dayanaklara kavuşturulmazsa, tıp ceza hukuku açısından çok önemli sakıncalar ve hukuksal sorunlar ortaya çıkacağı gibi, çağdaş tıp ve ceza hukuku ilkeleriyle çelişen birçok hukuka aykırılıklara da neden olacaktır. Çalışmada ana hatlarına değinilen bu yasal düzenlemeler ele alınmakta, açıklanarak nedenleri gösterilmekte ve çözümü için öneriler ileri sürülmektedir.

SOME PROBLEMS OF RECENT FORMULATIONS IN CRIMINAL
LAW RELATED TO MEDICINE LAW IN TURKEY

A considerable part of reforms that have been being made for a while in our country has been completed and with various changes in the decrees of prior drafts instead of principal laws that have been codes in terms of structure, new laws have been legislated and put into effect. A large section of these large-scale legal arrangements concern Medicine Criminal Law. In this study, since neither time nor space will suffice, only a part of these changes will be discussed. Legal arrangements to be discussed will be the ones, which have been brought about with this new criminal law system and which may cause potential problems in multifarious ways. First of all, it would be guiding to remind that a part of these regulations are related to subjects that have not existed in our legislation before and that are required for Turkey. Among these, experiments on humans, prescriptions, the obligation of informing the patient, rejection of treatment, hunger strike and medical attention regarding forceful feeding etc. can be mentioned. It has been appropriate to include these regulations principally. As a matter of fact, draft codes which had constituted the ground for these laws and which had been worked on for years had included a considerable portion of these subjects as well. However, these arrangements may give way to many potential inconveniences non-existed before rather than meet the requirements and principals of medicine and criminal law. This is due to the facts that some new arrangements or bodies have been improperly and deficiently established as against both national and supranational legal texts and also that these arrangements contain paradoxes in themselves which may lead to further confusion and problems. Besides being far from meeting the obligations, which are charged, to Turkish state by international agreements, a part of these new legal arrangements contain some improper and deficient decrees, which are against these international agreements concerning Medicine Criminal Law of which Turkey is a signatory or participant. Moreover, some of these arrangements contradict with the constitution or fail to meet the requirements of the constitution. For instance, contradictions with the decrees of European Bio-Medicine Contract and European Contract of Struggle against doping or the lack of arrangements, which are required by similar international contracts, may cause important problems. In this context, if a few examples, which are required to be re-arranged as envisaged by contemporary medicine and criminal law, are to be mentioned, the employment of new gene techniques, experiments on humans, prohibition of doping usage, active and passive euthanasia, drugs law and abortion actions can be counted. Some of these legal texts include remarkable paradoxes and deficiencies in terms of criminal procedure law. New legal arrangements about children, mentally disordered people and alcohol and drug addicts; arrangements about security and treatment measures, genital examination, professional secrets, experiments on children and physical damage can be examples from new Turkish Penal Code and Criminal Procedure Law. These new legal arrangements contain new crime types that are deficient and in contradiction with the legislation and against the principals of criminal law and medicine criminal law. New arrangements concerning abstention from testimony, constitution of DNA banks, annihilation of personal data and data records on physical identity detection, expertise, body examination, authorized post for basic medical procedures, the right to remain silent %u2013 nemo tenatur principle, causes for penalty regarding medicine law in various crimes, the effect of general decrees regarding crimes of neglect and violation of the obligation to help can be shown as examples to issues which need to be re-arranged. Principally, it has been proper to fill the gaps in our laws. However, if the deficiencies in these new arrangements are not corrected, false decrees are not removed, faulty and contradictory arrangements are not re-formulated and if subjects that have to be regulated and put under legal protection are not provided with grounds which are in accordance with International Laws and the Constitution, it will both cause contradictions with contemporary medicine and criminal law principals and create legal problems and drawbacks in terms of medicine criminal law. These legal arrangements that have been overviewed are discussed and explained and the reasons their re-arrangement are revealed and solutions are put forward in the study.

Adli Bilimler; doğal bilimlerin hukuki konulara uygulanması olup, çok çeşitli ve farklı faaliyetleri ve spesifik alanları kapsamaktadır. Kriminalistik, suçu, maddi gerçeğe uygun olarak ortaya koyan, iz ve eserleri ele geçirip değerlendiren bir bilim dalıdır. Bilimsel ve teknik araçlar yardımıyla suçluyu bulup suçu aydınlatma tekniğidir. Maddi delillerin hukuk içerisinde temel bilimlerin metotlarını kullanarak tanımlanması, değerlendirilmesidir. Pozitif bilimlerin metotlarını kullanarak iz çeşitlerinin, bunların somut olayda aranması, muhafaza altına alınması ve nihayet değerlendirilmesi tekniklerini ortaya koyar. Böylece kriminalistik beyanlar ile ikrarı da bilimsel incelemede dikkate almaz. Kriminalistik, olayların maddiyatının ortaya çıkarılması ve suça ait delillerin belirlenmesi ile ilgilenir ve bu açıdan da suçun bilimsel incelenmesi ile ilgisi yoktur. Kriminalist, teknik gelişmeleri ve araçları kullanarak, suçun çözümünde aktif görev alarak delil elde edip bunu değerlendiren uzmandır. Suçu ayırt etmede değil de, daha ziyade çözümlemede, delilleriyle aydınlatmada görevli kişidir. Bilimsel polis metotları, suçluların bilimsel yöntemler kullanılarak tespit edilmesi ve suç olaylarının aydınlatılmasını içerir. Uygulanacak kurallar ve teknolojideki gelişmeler kriminal incelemelerde büyük değişiklikler meydana getirir. Kriminalistiğin amacı ve ortaya çıkma sebebi, insanın şeref ve haysiyetini korumak, suçlunun şüpheden uzak maddi deliller karşısında masumiyet ya da suçluluğunu kesin olarak tespit neticesinde adli hata ve yanılmaları önlemektir. Kriminalistik, suçlunun ortaya çıkarılmasını hedeflediği kadar, masumun hatalı yere suçlanmasını önlemeyi de hedefler. Türkiye'de kriminalistik uygulaması daha çok resmi kurumlarca yerine getirilmektedir. Özellikle polis ya da jandarmaya ait olan bu kriminal laboratuvarlar ile Adli Tıp Fizik İhtisas Dairesi bu görevi yerine getirmektedir. Bazı incelemeleri özellikle kollukta çalışan ya da yukardaki kurumlardan ayrılan kişiler yapsa da bu iş için özel şartlar da gerekli olduğundan çoğu incelemelerde uygun ortamlara da sahip olunması gerekmektedir. Delil elde etmeyi ve delillerden sanığa ulaşmayı bilen, teknik alt ve üst yapıya sahip bir kolluk örgütünün bulunması, insan hakları ihlallerinin önlenmesi bakımından önemli bir işlevi yerine getirecektir. Kolluk, kriminalistik biliminin gerekleri ile bilgilendirilip donatılmalıdır ve bu alanda özel olarak yetiştirilmelidir. Kolluğun bilimsel verileri kullanarak delil toplama yöntemlerine ağırlık vermesi ve bu konuda kurulacak güçlü kriminal laboratuvarlardan yararlanması gerekir. Kriminalistik, ceza muhakemesinde insan hakları ihlallerinin önüne geçmede çok önemli bir araçtır ki, ceza muhakemesinin amacı da, insan haklarını ihlal etmeden maddi gerçeğin araştırılıp bulunması ve adaletin gerçekleştirilerek hukuk barışının sağlanmasıdır. Bilimsel metodlarla deliller, toplanıp değerlendirildiklerinde hata payı azalmakta, bazen tamamen ortadan kalkmaktadır ki, bu yönüyle de kriminalistik vazgeçilmez duruma gelmektedir. Maddi gerçeğin araştırılması sırasında insan hakları ihlallerinin önüne geçmedeki önemi, kriminalistiği, demokratik hukuk devletlerinde cazip hale getirmektedir. Bilimsel delil aşamasına geçilmesi halinde kriminalistiğin değeri, ceza muhakemesine yardımcı bir bilim olarak çok daha artacaktır. Günümüzde bilimsel metotlarla elde edilen deliller artık serbest delil sisteminin sınırlarını zorlamaktadır, hatta mutlak delil yasaklarına geçişte bu teknik gelişmelerin çok ilerlemiş olmasının da etkisi bulunmaktadır.

Forensic sciences are the application of natural sciences in law. Scientists dealing with forensic sciences enable the legal evaluation of cases by animating them with scientific methods. Forensic sciences are based on fundamental principles of biology, chemistry and physics.

As it%u2019s mentioned before forensic sciences are the application of natural sciences in law. Forensic sciences comprehend quite diverse and spesific fields. In practice, forensic sciences help justice to be realized by applying all principles and methods of biology, chemistry and physics. Sub-branches of foernsic sciences are forensic medicine, forensic dentistry, forensic antropology, forensic toxicology, criminalistic, forensic psychiatry, examination of signatures, firearms and fingerprints.

Criminalistic is the science that discovers criminal cases by obtaining and evaluating any kind of print and trace. It can also be described as the technique of finding the criminal and bringing the case to light by scientific and technical instruments or description and evaluation of evidences in law with the help of natural sciences. By using the methods of natural sciences, it puts the techniques of evaluation, description, collection and protection of evidences forward. As a result of this criminalistic does not take testimonies and confession into consideration in a scientific investigation. Criminalistic deals with the material aspect of criminal cases and evidences. That is why criminalistic has no relation with the legal examination of crime itself.

Criminalist is the expert who actively takes place in the investigation of criminal cases by using technical methods and instruments. Criminalist does not define or describe the crime he/she only deals with the evidences and tries to solve the case. Scientific methods used by the police aims to find out the offenders and solve the criminal cases. Application rules and the technological development affects criminalistic.

Protection of human dignity and avoiding legal mistakes in determination of innocense are the aims of criminalistic. Criminalistic aims both finding out the criminal and avoiding the incrimination of innocent people.

In Turkey, application of criminalistic is carried out by official institutions. Especially criminal laboratories of armed forces and Institution of Forensic Sciences deal with criminalistic. Apart from these some private laboratories have also been established by the former members of the institutions mentioned above; but these laboratories should have appropriate conditions. If armed forces know to find out the criminal from evidences and have the necessary technical background, this will be a very important development in preventing violation of human rights. Armed forces should be educated according to principles end methods of criminalistic. Armed forces should collect evidences by using technical datas and take advantage of criminal laboratories.

Criminalistic is such an important instrument of criminal procedure law for prevention of human rights violations that criminal procedure law aims to find out legal facts without violating human rights, realize justice and obtain legal peace. When evidences are collected and evaluated by scientific methods posibility of legal mistakes are reduced; so that criminalistic becomes inevitable. What makes criminalistic attractive in democratic state is it is importance in prevention of human rights violations. In the phase of scientific evidences, criminalistic will be more important for criminal procedure law. Today evidences obtained by scientific methods makes the system based on the freedom of evidences more diffucult to operate. It also has a very important role in the establishment of strict rules about illegal evidences.

Günümüzde tıp hukuku alanında daha çok tartışılan husus, hastanın haklarıdır. Buna karşılık hastanın yükümlülükleri konusu çok arka planda kalmıştır. Bu çalışmada, Tıp Etiği ve Tıp Hukuku Derneği%u2019nin kuruluşu vesilesiyle hekimleri de çokça ilgilendiren bu konuyu ana hatlarıyla ele almak istiyorum.

Hastanın yükümlülüklerinin başında %u201Cişbirliği yükümlülüğü%u201D gelir. Etkili ve başarılı bir tedavi, hastanın işbirliği olmaksızın mümkün olamaz. İşbirliğinden kasıt, hastanın tedavinin başarısı için çaba göstermesidir. Hasta işbirliğine zorlanamaz ise de, işbirliği yapmamasının hukuksal sonuçlarına katlanmak durumunda kalır. Bu sonuçlar, hastanın kusurlu kabul edilmesi ve bu durumun hekimin görevini yapmasını imkânsız kılması durumunda, hastanın tazminat zorunluluğunun doğmasıdır.

Hastanın ikinci yükümlülüğü %u201Chekimin tavsiyelerine uyma yükümlülüğü%u201Ddür. Hastanın tavsiyelere uymaması durumunda tedavinin başarısızlığı söz konusu olursa, hekimin tazminat yükümlülüğü söz konusu olmaz; aksine hekim, ücretini de talep edebilir.

Bir diğer yükümlülük, %u201Ckatlanma yükümlülüğü%u201Ddür. Hekimin tıbbi müdahalesinde başarılı olabilmesi için hastanın muayeneye ve müdahaleye katlanması gerekir. Katlanma yükümlülüğü hastanın pasif işbirliği yükümlülüğüdür.

Hastaya yönelik bir yükümlülük de %u201Cbildirme yükümlülüğü%u201Ddür. Hasta, hekime önceki hastalıklarını, hassasiyetlerini bildirmek zorundadır. Hastanın bu yükümlülüğü yerine getirmemesi, hekimin sözleşmeden doğan sorumluluğunu kısıtlayabileceği gibi, duruma göre tümüyle de ortadan kaldırabilir.

Hastanın son yükümlülüğü de %u201Cücret ödeme yükümlülüğü%u201Ddür.

LIABILITIES OF THE PATIENT

The most discussed issue in medicine law in our era has been the rights of the patient. On the other hand, the issue of patient liabilities has been overlooked. In this study, on the anniversary of Society for Medical Ethics and Law, in a broad frame, I would like to handle this issue, which also highly concerns medical doctors.

The major one of the liabilities of the patient is %u201Ccooperation liability%u201D. Efficient and successful treatment can never be achieved without the cooperation of the patient. Although patient cannot be forced to cooperate, he/she has to bear the legal consequences of uncooperating. These consequences can include the patient%u2019s being found faulty and in the case the doctor concerned can not perform his duty the patient can be obliged to pay indemnity.

The second liability of the patient is %u201Ccompliance with the advice of the doctor%u201D. In case a failure due to the disobedience of the patient to the advice of the doctor concerned occurs, the doctor cannot be claimed liable to pay indemnity; on the contrary, the doctor has the right to demand his fee.

Another liability of the patient is %u201Cendurance%u201D. In order for the doctor to be succesful in his medical attention, the patient has to bear medical attention, examination and treatment. Endurance liability is a form of liability of passive cooperation.

Another liability for the patient is %u201Cnotification%u201D. Patient has to inform his doctor about his prior illnesses and sensitivities. On the event that the patient fails to fulfill, the accountability of the doctor from the contract may be restricted or the contract may be rendered unbinding for the doctor, which means annulment of the contract.

The last liability of the patient is %u201Cpayment of fees%u201D.

Hekimlik, tüm dünya toplumlarında en fazla saygı duyulan mesleklerin başında gelir. Mesleğin sunduğu ekonomik imkânların ötesinde bunun en önemli sebebi, modern toplumlarda anayasalarla en üstün değer olarak korunan insanın yaşam hakkını, vücut bütünlüğünü ve sağlığını konu edinmesidir. Ancak bu saygınlık, meslek sahiplerinin mesleklerini icra ederlerken kusurları ile meslek kurallarına aykırı olarak verdikleri zararlardan sorumlu olmalarını engellememiştir.

Hekimlerin tıbbi müdalelerden dolayı sorumluluğu kapsamında değerlendirilen hasta hekim ilişkisi bugün başlı başına bir hukuk dalı olarak kendisini kabul ettiren Tıp Hukukunun konusu olmuştur. Bu gelişmede son elli yılda insan hakları konusunda yaşananlar, özel hukukda uyuşmazlıklarda zayıf tarafın korunması ilkesi, tıp ve diğer fen bilimlerinin hızlı gelişmesi ve beraberinde getirdiği etik, ekonomik ve hukuki sorunların çözümlenme ihtiyacı önemli rol oynamıştır. Hem Avrupada, özellikle Alman hukukunda, hem de Türk hukukunda Tıp Hukukunu başlı başına düzenleyen özel hükümlerin olmayışı, uyuşmazlıkların hekim-hasta ilişkisinin nitelenmesine bağlı olarak benzer sözleşme ve sözleşme dışı sorumluluk hükümleri ile çözümlenmeye çalışılması, Tıp Hukukunu bir hâkim hukuku olarak karşımıza çıkarmıştır.

Hasta-hekim ilişkisinde, hekimin temel yükümlülükleri olarak karşımza çıkan tıp ilmine uygun teşhis ve tedavide bulunma borcu ve kişinin yaşam, vücut ve sağlık hakkına ilişkin tıbbi müdahalenin hukuka uygunluğunu sağlamaya yönelik aydınlatma borcunun yanında üçüncü bir yükümlülük olarak karşımıza belge düzenleme ve saklama yükümlülüğü çıkmaktadır. Bu yükümlülük, doğrudan yasal düzenlemelerden kaynaklanabileceği gibi, hekim-hasta arasındaki sözleşme ilişkisinden de doğabilmektedir. Hukuki mesnedi farklı olmakla beraber belge düzenleme ve saklama yükümlülüğünün üç temel işlevi söz konusudur. Birincisi hastanın bilgi alma hakkını güvence altına almasıdır ki, özellikle Hasta Hakları Yönetmeliği%u2019nde açıkça düzenlenmiştir. Bu işlevi ile yükümlülük, hastanın sağlık durumu hakkında yazılı bilgiye ulaşmasına izin vermektedir. Ayrıca, hekimin hatası olup olmadığı ve hekime karşı tazminat davası açılıp açılmamayacağına yönelik karar verilmesine de yardımcı olmaktadır. Diğer bir işlevi ise tıbbi müdahalenin teşhis ve tedaviye ilişkin seyrini, hem müdahalede bulunan hekim, hem de diğer meslektaşları için takip edilebilir kılarak, tıbbi müdahalenin gereği gibi yapılmasına hizmet etmektir. Bu işlevi ile yükümlülük, asli edimin ifasına yönelik olarak hastayı koruyucu bir yan yükümlülüktür. Nihayeti ile son ve üçüncü işlevi ise, tazminat davasında ispat aracı olmasıdır.

Hekimin belge düzenleme ve saklama yükümlüğünün kapsamının ve bu yükümlülüğün ihlâli halinde sonuçlarının ne olacağının özellikle tazminat hukuku açısından cevaplandırılması gerekir. Sözleşme ilişkisine dayalı dökümantasyon yükümlülüğünün anamneze, teşhis ve tedaviye ilişkin olarak müdahalede bulunan hekimin veya diğer bir hekimin değerlendirmesine yetecek bilgileri içermeleri gerekir. Hastanın bilgi alma hakkı açısından bu yükümlülüğün ihlâl edilmesi halinde ifası dava edilebilirken, tıbbi müdahalenin gereği gibi ifasına hizmet ettiği hallerde bir koruma yükümü olarak ancak tazminat davasına konu olabilecektir. Belge düzenleme ve saklama yükümlülüğünü ihlâl ederek tazminat davasında iddiasını ispatlama yükü altındaki hastanın bu imkânını elinden alan hekimin bu davranışı, kendi lehine sonuç doğurmamalıdır. Bu halde, hem dürüstlük kuralına, hem de adil yargılanma hakkına dayanarak tazminat davalarında ispat yükünün ters çevrilmesi söz konusu olabilecektir.

Medical profession is among the most respected professions in all societies of the world. The most significant reason contributing to this fact is that, beyond its financial outcomes, the profession takes the right of living as its major issue and strives to protect the integrity and health of the body, which have also been secured by constitutional laws. However, this respect for the profession has not rendered doctors unaccountable from their faults and the damages they have caused while carrying out their professions.

Doctor %u2013 patient relationship, which has been evaluated under the framework of the responsibility of doctors for medical treatments so far, today, has been the subject matter of Medical Law. Among the factors contributing to this change, the developments that have been observed in the last fifty years, the principle of protecting the rights of weak at private law disputes and the rapid development in medicine and other sciences and the need for the ethic, economic and legal problems to be solved which have been brought along with these developments have played a great role. Both in European Law, particularly in German Law and in Turkish Law the lack of special decrees which regulate Medicine Law separately and the effort to settle the disputes by means of decrees of responsibility which may or may not exist in contracts have caused Medicine Law to be a judge (ruling) law.

Besides the liability of making diagnosis and treatment proper to medical science and the liability of providing that the medical attention concerning the right of the patient to health and body integrity is in accordance with laws, in patient-doctor relationship arises another liability for the doctors to prepare and preserve documents. This liability can source from directly legal regulations as well as from the contract relationship between the patient and the doctor. Although its legal base may differ, the obligation of the doctors to prepare and preserve documents has three basic functions. The first of these is that this liability guarantees the right of the patient to receive information and this fact has been clarified also in Patient Rights Regulation. With this function, the liability permits the patient to acquire the written information about his health condition. Moreover, it helps to arrive at a decision as to whether the doctor is faulty or a suit for damages can be commenced against the doctor concerned. Another function of this liability is that it helps the treating doctor and also other doctors to be able to follow-up the process of medical attention concerning both diagnosis and treatment thus serving to proper functioning of medical procedures. By this way, it becomes a complementary liability which aims to protect the patient according to fulfillment of principal action. Its third and final function is that it operates as a means of proof at suits for damages (actions for compensation).

The scope of the liability of the doctor to prepare and preserve documents and in case of violation of this liability its sanction on the doctor should be clarified in terms of damages law. Contractual documentation liability envisages that there should exist sufficient information as to the anamnesis, diagnosis and treatment, for the treating doctor or another doctor to be able to evaluate. While in case of violation of this liability, in terms of the patient%u2019s right to receive information, its fulfillment can be sued, it can only be the subject matter at suit for damages as a protection measure in cases where it serves to the fulfillment of proper medical attention. If a doctor violates the liability to prepare and preserve documents and prevents the patient to be able to prove his allegation at suits for damages, it should not bear a consequence in favor of the doctor. In this case, a reversion in burden of proof (onus probandi) at suits for damages may occur based on the right to honesty and fair trial.
